Personal Data Protection Legislation - Internet Site Visitor Information Notice

As Bor Şeker A.Ş. ("Bor Şeker" or "the Company"), in our capacity as data controller, we inform you that the personal data we obtain from you will be recorded, stored, and retained accurately and up-to-date, within the framework of the purposes specified under the Personal Data Protection Law No. 6698 (“KVKK”) and as detailed below. We may share your personal data with legally authorized institutions that are entitled to request such data, and transfer them to third parties under the conditions stipulated by the KVKK.

Definitions Related to KVKK

For the purposes of KVKK:

  • Anonymization: Making personal data unable to be associated with an identified or identifiable natural person, even when matched with other data,

  • Data Subject: The natural person whose personal data is processed,

  • Personal Data: Any information relating to an identified or identifiable natural person,

  • Processing of Personal Data: Any operation performed on personal data such as obtaining, recording, storing, preserving, altering, reorganizing, disclosing, transferring, acquiring, classifying, or preventing its use,

  • Board: The Personal Data Protection Board,

  • Authority: The Personal Data Protection Authority,

  • Data Processor: The real or legal person processing personal data on behalf of the data controller based on authority,

  • Data Registration System: The system in which personal data is structured and processed according to certain criteria,

  • Data Controller: The natural or legal person who determines the purposes and means of processing personal data and responsible for establishing and managing the data registration system,

  • Special Categories of Personal Data: Data related to race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, dress, association, foundation or trade union membership, health, sexual life, criminal conviction and security measures, as well as biometric and genetic data.

What Are Personal Data? Which Personal Data Are Processed?

Personal data refers to any information that identifies or makes you identifiable. This mainly includes your identity information such as your full name and national ID number, as well as contact information like address and phone number, bank account details, and any other information that can be linked to you. Special categories of personal data as defined under Article 6 of the KVKK include data regarding race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, association or union membership, health, sexual life, criminal convictions and security measures, biometric and genetic data. Our company does not process any of your Special Categories of Personal Data.

How Do We Collect and Process Your Personal Data?

Your personal data is collected electronically through automatic methods when you fill out contact forms on our website or communicate with us via online instant messaging applications.

How Is the Security of Your Personal Data Ensured?

Bor Şeker places great importance on protecting the confidentiality and security of personal data. Necessary technical and administrative security measures are implemented to protect personal data from unauthorized access, damage, loss, or disclosure. System controls, data access controls, secure transfer controls, business continuity measures, and other institutional controls are in place.

Do We Transfer Your Personal Data to Third Parties or Abroad?

Bor Şeker commits to securely safeguarding your personal data and ensuring lawful processing. If necessary and upon request, we may share your personal data with authorized domestic public institutions and organizations. In addition, due to use of foreign-based email or online instant communication services, your name, surname, email address, and request information may be transferred abroad with your explicit consent pursuant to Article 9 of the KVKK.

What Are Your Rights as the Data Subject and How to Apply?

You have the following rights regarding your personal data processed by Bor Şeker:

  • To learn whether your personal data is processed,

  • To obtain information if your personal data is processed,

  • To learn the purpose of processing and whether your data is used accordingly,

  • To know the third parties to whom your data is transferred domestically,

  • To request correction if your personal data is incomplete or inaccurate,

  • To request notification of corrections, deletions, or destructions to third parties,

  • To request deletion or destruction of your personal data where processing reasons no longer exist,

  • To object to results against you arising from automated processing,

  • To claim compensation for damages caused by unlawful processing.

You may submit your requests via our application form on the website, in writing by hand, mail, cargo, notary, via secure electronic signatures, mobile signatures, registered electronic mail (KEP), or the email address you provided to us (kvkk@borseker.com).

Bor Şeker will conclude your requests free of charge within thirty days at the latest, and may charge fees only as determined by the Board if costs arise.

Requests may be accepted or rejected with justifications in writing or electronically. If accepted, Bor Şeker will fulfill the request promptly.
